Carpods Facebook Competition MotorEx 2019

Terms & Conditions


The Carpods Facebook Competition Melbourne (the Competition) is an online competition hosted on the Carpods Facebook page. Users are required to engage with the competition posts to enter. All entries must meet conditions of entry as stated throughout these terms and conditions (Terms and Conditions).

The promoter is Carpods Pty Ltd (ABN 41 623 148 345) of 1/13 Network Drive, Carrum Downs, VIC 3201 (the Promoter).

Information on how to enter, mechanics of entry and the prizes form part of these Conditions of Entry. Entry into this Competition is deemed acceptance of these Conditions of Entry.


  1. Entry is only open to Australian residents aged 18 years or over. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies directly associated with the conduct of this Competition are ineligible to enter this Competition. Entry into and participation in this Competition is free. Entrants may enter any number of times. Correct entrants only enter the final draw once.   



  1. The Competition commences at 8:00am AEST on Saturday 11th May 2019 and final entries close at 4:00pm AEST on Sunday 12th May 2019 (Competition Period).

  2. The vehicle will be unveiled at MotorEx 2019 at 4:10pm AEST on Sunday 12th May 2019.

  3. The Promoter is giving away to the winner a single amount of $1000.00 (One Thousand Dollars AUD) (the Prize).  There will be one (1) Prize winner for the Competition.



  1. To enter, during the Competition Period, entrants must:

    1. Use the clues/hints provided during the Competition Period on the Carpods Facebook page (also announced at MotorEx 2019) and guess the vehicle that is hidden in the closed Carpod on display at MotorEx 2019 during the competition period.

    2. Click the link provided on the Carpods Facebook page and complete the competition entry form.

    3. Like & follow the Carpods Facebook page.

    4. There is no limit to the number of entries per person.

    5. A correct answer gives you one (1) entry in the final Prize draw.



  1. All entrants must complete all sections of the online form including first name, last name, email, phone, make, model, series and year.

  2. Entrant must answer the fields make, model, series and year correctly to gain entry in the final Prize draw.

  3. The judging panel will, in its sole and absolute discretion, select the correct forms and place those names into the final Prize draw.

  4. The Prize draw is a game of chance with the winner drawn at random.

  5. The judging will take place at Carpods Pty Ltd of 1/13 Network Drive, Carrum Downs, VIC 3201. This is a game of chance and no skill plays a part in determining the winner. The draw is final and no correspondence will be entered into.

  6. The winner during the Competition Period will be announced at 5:00pm AEST on Saturday 18th May 2019.

  7. The winner will be required to respond to the Private Message/Direct Message/email from Carpods within two (2) business days.  Upon the Promoter or its agency for this Competition receiving a reply providing the details below, the winner will be forwarded the Prize.  The winner will be required to supply Carpods with the following details:

    1. Full name

    2. Email address

    3. A contact phone number

    4. Australian bank account details that the winner wishes the winnings to be transferred to

    5. Proof of Age if requested by Promoter (example photocopy of proof of age card, driver’s license, passport, etc.) and guardian permission where applicable

  8. The Prize will be transferred to the winner using the winner’s bank account details submitted during process. The Prize winner must supply bank account details to the promotor to receive the Prize.

  9. The Promoter accepts no responsibility in the event that a winner’s bank account details are incorrect or if the Prize cannot be accessed or claimed by a winner due to circumstances beyond the Promoter’s control.

  10. Prizes (and ALL components of Prizes) are not transferable or exchangeable and cannot be redeemed or taken as cash (unless otherwise indicated).  Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.  The Promoter and its partners and agents accept no responsibility for any variation in Prize value.  All Prize values are the recommended retail price including GST (where applicable) and are correct at the time of printing.

  11. This Competition is in no way sponsored, endorsed, or administered by or associated with Facebook and/or Twitter and/or Instagram (each, a Social Media Provider). Nor is this Competition sponsored, endorsed, or administered by or associated with MotorEx. Each entrant acknowledges that the information that they provide is provided to the Promoter and not to any Social Media Provider. The information that any entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to any Social Media Provider. No Social Media Provider or the Promoter or its partners and agents will be liable for any loss or damage or personal injury which is suffered or sustained by an entrant as a result of participating in the Competition (including the taking or use of any prizes), with the exception of any liability which cannot be excluded by law.

  12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. The Promoter will disqualify any entrant who, in the absolute opinion of the Promoter, has or has attempted to, tamper with the entry process. Errors and omissions will be accepted at the Promoter's absolute discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  13. Without limiting any of the provisions of these Terms and Conditions, the Promoter requires that an entry must fully comply with these Terms and Conditions and must not include or make reference to the intellectual property rights of any person including but not limited to any visible logos, drawings, cartoons, phrases, trademarks, copyrighted material, mark that identifies a brand or other third party materials, unless the entry is submitted with the written consent of the owner of the applicable intellectual property rights. An entry submitted which does not comply may result in the entry becoming invalid for the purposes of this Competition and/or the entrant being subject to legal liability.

  14. An entry that contains content that the Promoter, in its absolute discretion, considers:

    1. to be offensive or inappropriate (or encourages offensive or inappropriate content to be posted), including but without limitation, content that is offensive or potentially offensive to MotorEx; or

    2. would infringe the intellectual property rights or other rights of any person, corporation, entity; or

    3. contrary to the law;

      1. will not be accepted as an eligible entry into this Competition. This includes, but is not limited to, any entry which the Promoter considers to be disparaging to its products and/or services or is otherwise not in keeping with the spirit of the Competition. The promoter may, in its sole and absolute discretion, remove any content without any notice to the entrant for any reason whatsoever.

      2. By uploading, commenting or otherwise making available any content in connection with this Competition, the entrant grants to the Promoter a non - exclusive, worldwide, royalty free, perpetual licence to use and sub-licence, publish, reproduce and otherwise exploit the copyright and other intellectual property rights in any entry submitted and any related content in any form for any purpose. Content submitted in connection with this Competition will not be returned to any entrant. Each entrant acknowledges that any intellectual property rights created by an entrant in taking part in this Competition vests in the Promoter upon the content or entry being submitted for this Competition. To the extent that any ownership does not vest in the Promoter, the entrant assigns to the Promoter all of the entrant’s intellectual property rights (if any) which may subsist in an entry or any related content as a result of this Competition.  Each entrant warrants that entry content is lawful and not misleading and that the Promoter’s use of such content will not infringe the intellectual property rights (or other rights) of any third parties.

  15. The Promoter has no obligation to credit an entrant as the author of any content submitted for the purpose of entering this Competition and each entrant acknowledges that the Promoter may otherwise do any acts or omissions which would otherwise constitute an infringement of any moral rights (as defined in the Copyright Act 1968 (Cth)) an entrant may have as an author of any such content.  For the purposes of these Terms and Conditions “intellectual property rights” means all present and future intellectual and industrial property rights throughout the world, including (but not limited to) all rights in respect of copyright in all literary works, artistic works, any other works or subject matter in which copyright subsists and may in the future subsist.

  16. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  17. Any ancillary costs associated with redeeming the prize, such as the cost of travelling to the event are not included in the Prize.

  18. If for any reason a winner does not redeem the prize by direct messaging on Facebook OR emailing Carpods with their full name, contact number, email, bank account details and proof of age details within two (2) business days of the winner being announced in accordance with these Terms and Conditions, then the winner will be deemed to have forfeited the prize. In this scenario the Promoter reserves the right to select an alternate winner.

  19. The entrant consents to the Promoter and its associated companies and agencies using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media or promotional materials for a period of two years from the end of the Competition Period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  20. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel this Competition, as appropriate.

  21. Any cost associated with accessing any Competition website is the entrant’s responsibility and is dependent on the Internet service provider used.

  22. The Promoter collects personal information in order to conduct this Competition and may, for this purpose, disclose such information to third parties who are engaged by the Promoter for the purpose of this Competition in accordance with terms of the Promoter’s Privacy Policy and applicable laws.  An entrant should direct any request to opt out, access, update or correct information to the Promoter’s Privacy Officer.

  23. To the extent permitted by law the Promoter (including its partners and each of their officers, employees and agents) excludes all liability for any loss, damage or personal injury (including liability in negligence) or any loss of opportunity, whether direct, indirect, special or consequential, arising in any way out of the Competition and an entrant’s participation in the Competition, including any such liability, loss or damage that arises out of the following: any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); any theft, unauthorised access or third party interference; any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; any tax liability incurred by the winner or entrant; any prize or participation in or use of any prize.

  24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under any similar consumer protection laws in the State and Territories of Australia.

  25. The Competition and these Terms and Conditions will be governed by the law of the State of Victoria, Australia.  Entrants submit to the non-exclusive jurisdiction of the courts of Victoria, Australia in connection with all disputes arising out of or concerning the Competition and these Terms and Conditions.
